As an expert litigator, Mr. Bailey won the first million-dollar result in Chautauqua County history, to serving in the lead counsel organization of approximately 50 percent of all the “price fixing” class cases. His involvement in civil (i.e., private) antitrust class action cases representing plaintiffs totals at nearly 200 class action lawsuits. He has helped engineer courtroom victories or settlements against a wide array of big corporations, and executives. Mr. Bailey’s cases include many legal matters involving food and agricultural issues, he is involved in very complex, price-fixing cases against the meat industry (tuna fish, broiler chickens, pork, turkeys, and beef). Mr. Bailey is also deeply involved as well as the farm-related anti-competitive antics allegedly occurring by and among the huge suppliers of agricultural chemicals and seeds, lumped as “Crop Inputs” litigations.
A noteworthy case Mr. Bailey was involved in was the “Vitamins case” in which he successfully settled a class action lawsuit with Blue Cross/Blue Shield for 2.7 billion dollars and the national and state Opioid Drug Litigation, all following the NCAA athletes’ and the NFL Players’ Concussion Litigation case.
Mr. Bailey credits his success in antitrust or competition law to his unique ability in knowing the subject matter, knowing the audience, and being able to explain the former to the latter efficiently and effectively. He loves to speak about litigation techniques because it requires many of the same skills as being a great trial attorney. Mr. Bailey has been an invited lecturer at legal conventions around the world and at more than 40 state bar associations and trial lawyers organizations in the United States.
Mr. Bailey is admitted to the New York State Bar and received his J.D. from the University at Buffalo School of Law and earned his B.A. from the State University of New York at Buffalo.
