Arthur N. Bailey is a partner in of the 65-attorney state-wide New York law firm of Rupp Pfalzgraf, LLC with offices in Buffalo, Rochester, Jamestown, Albany, and Niagara Falls.
Over the past 50 years, Mr. Bailey has become nationally prominent as an expert litigator, having won the first million-dollar result in Chautauqua County history in a negligence case. After specializing in the civil antitrust/class action field, he has earned the distinction of having filed or participated in more than half of all the “price-fixing” class action cases that were handled by the entire antitrust division of the U.S. Department of Justice.
He has helped engineer courtroom victories or settlements against a wide array of big corporations and their executives. Mr. Bailey’s cases include many different products and services with many involving food and agricultural markets. His nationally sought-after legal creativity was instrumental in bringing about the landmark cases of Tuna Fish, Broiler Chickens, Pork, Turkeys, and Beef.
Mr. Bailey’s cases also have involved the illegally anti-competitive agricultural markets where he is now involved in very complex, price-fixing class actions involving the huge suppliers of agricultural chemicals and seeds, lumped together as “crop inputs.” Other noteworthy cases brought on by Mr. Bailey’s clients were the “Vitamins case” and the “Blue Cross/Blue Shield case”, both of which were settled for $2.3 and $2.7 billion respectively.
He is now one of the original attorneys in the huge Opioid Drug litigation, both in Federal and State class actions. Similarly, he was involved in the famous NCAA class action which “broke the amateur status barrier” for all college athletes and eventually, he was a front-liner in the NFL Players Concussion Litigation Class Action.
Mr. Arthur N. Bailey credits his success in this specialized field of antitrust law to his unique ability of studying the subject industry, studying the victims, and being able to explain the former to the latter with “erector-set” simplicity, then easily understood. He loves to lecture about litigation techniques because they all translate into acquiring and using the same skills possessed by every great trial lawyer. As a result, Mr. Bailey has been an invited lecturer before more than 40 different state bar associations and/or state trial lawyer organizations in the United States, and in more than eight different foreign countries.
He is equally proud of the other full-service skills of his Rupp Pfalzgraf, LLC firm which, for three decades, has represented multiple clients in a variety of litigation matters such as in insurance defense, civil rights litigation, (including §1983 matters) environmental law, labor/employment law, real estate law, banking law, and many other fields of law.
