Attorney, Neal J. Fialkow, primarily focuses on complex litigation and specializes in Labor and Employment Law. In 2017, he was recognized by The Daily Journal, which is the legal newspaper for the State of California, as one of the Top 75 Labor Employment Lawyers in the state. The use of Class Actions and acting as a Private Attorney General in the State of California, has been his principal methods for achieving great successes for his clients and changing and shaping the law in innovative ways. For example, in 2013, Fialkow litigated a Class Action on behalf of car technicians against Downtown LA Mercedes Benz wherein they were paid a “piece-rate” instead of an hourly rate for the work that they did on cars that came in to the shop for repairs. Workers, however, were required to stay on-site and do non-repair tasks without pay, even when they weren’t repairing cars. “Legally, the piece-rate cannot go below the minimum wage”, Fialkow said.  The California Court of Appeals affirmed the trial court decision and ruled that workers who worked at a per case basis fixing cars were entitled to the minimum wage when waiting for other cars to come in for repair. Gonzalez v Downtown LA Motors, LLP, 215 Cal.App 4th 36. “That defined piece-rate and kind of changed everything in California,” Fialkow said.

In a later appellate case, Hernandez v Ross Stores, Inc., the Court of Appeal ruled that even where employers have an arbitration provision when cases are filed under the Private Attorney General Act of California, the cases can go straight to a judge instead of an arbitrator first in assessing the case for arbitration. Court observers predicted that this decision would result in many more Private Attorney General Actions claims being filed, and, in fact, that has clearly been the case.

Mr. Fialkow’s law office generally accepts large employment cases from other attorneys on a referral basis, but employees are invited to call his office directly to see if they might have a case worth pursuing.

Mr. Fialkow was admitted to the State Bar in 1977 and has been practicing law for over 40 years. He is considered to be an out-of-the-box thinker who does not accept the status quo and solves problems with a creative approach for each case.
