Howard Gest, partner at the firm, represents public and private entities in a wide range of litigation matters in both state and federal court and before regulatory agencies. Mr. Gest has particular expertise in water quality, mobile air quality, and contaminated property matters, as well as years of civil litigation experience. He is a member of the California Bar Association and the Los Angeles County Bar Association. He was previously a member of the Board of Directors of the Western Center on Law and Poverty.
Mr. Gest was lead counsel in the federal and appellate courts and on the briefs in the United States Supreme Court on behalf of his clients in Los Angeles County Flood Control District v. Natural Resources Defense Council, Inc., 568 U.S. 78 (2013), a unanimous ruling in favor of his clients. He was the lead attorney for the real parties-in-interest municipalities before the California Supreme Court in Department of Finance v. Commission on State Mandates, 1 Cal. 5th 749 (2016), in which the Supreme Court held that California municipalities were entitled to reimbursement for state mandates imposed under municipal stormwater permits, as well as representing the municipalities before the Commission on State Mandates and the trial and appellate courts. He was also the lead attorney for plaintiffs in County of Los Angeles v. Commission on State Mandates 150 Cal.App.4th 898 (2007), which found unconstitutional a state statute that had prevented local governments from seeking reimbursement for unfunded state mandates.
He has particular expertise in CERCLA and cost recovery actions, representing both plaintiffs and defendants. He represents private corporations and individuals in various commercial disputes and heath care providers in health care contractual litigation matters.
Following graduation from law school from the University of California, Hastings College of the Law, Mr. Gest worked as an Assistant United States Attorney for the Central District of California where he developed his litigation expertise representing the United States and its agencies, including the Environmental Protection Agency, the Small Business Administration, the Department of the Interior, and the Forest Service.
Mr. Gest holds Martindale-Hubbell’s coveted AV Preeminent rating, and is recognized by SuperLawyers of Southern California. He is also published: Los Angeles County Flood Control District v.
