Brian Daucher is admitted to practice law in California and holds Martindale-Hubbell’s coveted AV Preeminent rating. He has been admitted to practice in courts throughout the country, including the U.S. Supreme Court and the Fifth, Ninth, Tenth, D.C., and Federal Circuit Courts of Appeal, as well as pro hac vice admissions to prosecute litigation in New York, Virginia, New Jersey, Pennsylvania, Florida, Texas, Arizona, Utah, Hawaii, and the state of Washington.
Mr. Daucher concentrates his practice with an emphasis on contract, healthcare, and intellectual property disputes, Daucher has represented clients in a wide range of industries including healthcare, technology, consumer products, fiduciary and banking services, food and alcohol, and energy. He has tried cases throughout the country, in both state and Federal court, as well as before private arbitrators.
For plaintiffs, Daucher’s results include an $8 million arbitration award for a terminated reseller against Avaya (2014), a $6.4 million jury verdict for a terminated reseller against Cisco Systems (2008), and a $16 million jury verdict against a commercial institution for fraud in connection with loan underwriting (2006).
On the defense side, Daucher obtained a full defense judgment against a $66 million post-acquisition earn out claim (arbitration 2015), a full defense judgment against a claim for constructive trust over undeveloped land valued at $20 million (bench trial 2006), and a judgment rejecting a trustee petition to confirm extraordinary compensation of $45 million (bench trial 2005).
From 2008 to 2012, he prosecuted a series of Federal cases resulting in the invalidation of a Federal hospice payment cap regulation. In connection with this multi-district litigation, he obtained orders setting aside more than $75 million worth of overstated provider repayment demands.
In 2018, he served as President of Project Youth OCBF, a charity focused on preserving and extending opportunity for Orange County youth. In 2012, he served as Chair of the OC Bar Association’s Judiciary Committee, charged with reviewing applicants and candidates for state judicial positions.
Daucher graduated from Dartmouth College with a B.A. in Economics (1991) and received his J.D. from Duke University School of Law (1994).
