Mr. Roy has substantial experience in representing employers in workers’ compensation law matters such as applications for discrimination benefits pursuant to Labor Code §132a and petitions for serious and willful misconduct pursuant to Labor Code §4553. Mr. Roy routinely prepares employee handbooks, extensive policies regarding sexual harassment and discrimination, Family and Medical Leave Act issues, and fitness-for-duty examinations.
Apart from traditional labor law issues, Mr. Roy’s practice routinely includes representation of agricultural and commercial workers before the following federal administrative agencies: National Labor Relations Board, Equal Employment Opportunity Commission, and U.S. Department of Labor. Mr. Roy also represents agricultural employers before the following State administrative agencies on an ongoing basis: Agricultural Labor Relations Board, Department of Fair Employment and Housing, Department of Pesticide Regulation, Division of Labor Standards Enforcement, Cal/OSHA Appeals Board and the Employment Development Department.
Mr. Roy received his B.A. degree from U.C. Irvine in Spanish (Culture and Linguistics), followed by a Juris Doctorate degree from California Western School of Law in San Diego, California. He has represented the agricultural industry for over 40 years. Mr. Roy is a member of the bars of the California Supreme Court, United States Supreme Court, the U.S. 9th Circuit Court of Appeals, as well all four U.S. District Courts in California.
For 18 years, Mr. Roy served as Chairman of the American Bar Association Sub-Committee on State Agricultural Labor Law Developments. Beginning 1977 to the present, Mr. Roy has served as the President and General Counsel of Ventura County Agricultural Association, a non-profit agricultural trade association representing the interests of over 200 farmers, packing houses, farm labor contractors and related employers located in Ventura and Santa Barbara Counties. Mr. Roy specializes in labor and employment law and is engaged in extensive representation of the above employers before State and Federal courts and administrative agencies.
In addition to administrative law, Mr. Roy has represented employers in Appellate and Superior Courts involving such matters as wage and hour issues, sexual harassment, prohibited discrimination, retaliation, disability discrimination, wrongful discharge based upon contract and public policy, and pesticide issues. He has extensive experience in wage and hour class action cases and also served on the legal team that developed AB 1513 for Non-Productive Time and the proper payment of Rest and Heat Recovery periods in California.
Lastly, Mr. Roy is a member of the Labor and Employment Sections of the American Bar Association and the California State Bar, respectively, and the Ventura County Bar Association. Mr. Roy is rated “AV” Preeminent by Martindale-Hubbel 2017, Top 1% of America’s Most Honored Professionals 2016, AV rated by Martindale-Hubbel in 2014 for Highest Possible Rating in both Legal Ability & Ethical Standards, Who’s Who in Ventura County Agriculture & Viticulture 2012, Who’s Who in American Law, and the U.S Congressional Record-107th Congress (Oct. 31, 2001) for his contributions to U.S agriculture.
